I have clients (Louis and Martha Berecz) selling property located in Erie County, NY (60 Eileen Court, Cheektowaga, NY). On April 4,1991, they took out a mortgage with Advanced Financial Services, Inc. for $29,000. That mortgage was assigned to Commercial Credit Corporation on April 9, 1991 and remains undischarged to this date, though it was paid off. In 1996, Mr. and Mrs. Berecz took out a mortgage with your company for $54,519.40 which was subsequently discharged. This mortgage , recorded in Liber 12703 of Mortgages at page 5120, recites that it was consolidated with the earlier $29,000 mortgage, but the discharge (recorded in Liber 12798 of Mortgages, page 3046) failed to recite that it discharged the earlier $29,000 mortgage and is therefore defective for that reason and also for the fact that the earlier mortgage was assigned to Commercial Credit Corporation and not Commercial Credit Plan, Inc. of Georgetown.
